This seems like to based on the basic principle of contract on the 4.99 limit, which is a term implemented after the contract is formed. It means that if you are unaware of any term that was not in the contract that you have signed, then the additional term is valid after signing the contract.
There is no condition to add any type of deal when any contract mobile phone deal is signed. I don't know if there is a any law against it, but you can write letter to both of your network provider and company that to provide the facility or you will go a legal action.
